Westfield police stopped a motorist in Westfield for allegedly speeding. He insisted that the police stopped the wrong vehicle and he has video to prove it while spending thousands of dollars on his defense.

TFoTM has reviewed the front and rear dash-cam video footage in its entirety. Based on the video reviewed, it appears the wrong vehicle was stopped by police.

There is obviously probable cause to stop. There is also evidence of reasonable doubt. Once the ticket is issued, the cop can do nothing except speak to the Prosecutor.
ReplyDeleteIn the present matter, the Prosecutor should have seen the problem when she was shown the video by the first lawyer. The police have no power once the ticket is written. The ethics of a Prosecutor requires that prosecutor to tell the Court the State has a problem.
The present defense lawyer shouldn't complain about the cops, he should complain about a Prosecutor not doing the job of a Prosecutor.
Agreed, however I'd be curious to know how the IA complaint was handled once the driver in question made his complaint, was it according to policy and procedures or did the Officer who handled the IA complaint violate any guidelines regarding how IA complaints should be properly handled. The 2nd Attorney is making some strong statements.
ReplyDeleteThe municipal court system is absolutely broken. Instead of real law enforcement the police are instead preying upon the weak, stupid, ignorant, or lesser informed public. The summons will always lead to a plea agreement with the prosecutor which in turn leads to the fines that the town lines their coffers with. After all, this is how the Westfield town piggy bank is flush with cash so people like Jim Gildea can keep those six figure positions and the DPW can continue to milk the cash cow of unlimited overtime. It's a vicious cycle and it will not change.
ReplyDeleteComment number two says that attorney #2 is making some strong statements. In truth, the attorney is making strong allegations with little or no proof offered beyond his inflammatory statements.
ReplyDeleteThe following commenter needs to file his FACTUAL basis with the Supreme Court committee on judicial conduct and the Attorney General concerning the Prosecutor. He makes inflammatory statements and charges and withholds any semblance of FACTS to support it.
He might be interested in the division of money between the State and the Municipality mandated by Trenton. He might find that there is little incentive to look at Court as a cash cow for the Municipality.
It seems much more logical that broadsides delivered by counsel should be taken for the "upmanship" improperly practiced by some attorneys. Please remember that attorneys are required to tell the truth when acting officially before the Courts.
When talking over beer or telling others what results he expects in a case, the lawyer should be judged by his track record and reputation.
Hey, Greg. I think your approach to "uncensored" is great, but how about a moderator's redaction of the name at the end of the comment from August 10? The family is still in town, and there is no possible good that can come from speaking ill of the dead in that manner. (That's my polite commentary on that post......)
