Westfield Municipal Court Prosecutor In Violation of NJ Title 39 Motor Vehicle Law

Westfield, New Jersey Municipal Court Prosecutor Yvette Gibbons prosecutes motor vehicle infractions while continuing to drive a motor vehicle that bears an inspection sticker that expired in December of 2017.  This is a violation of NJ Title 39:8-1 "Failure to have inspections."

How can an appointed official of the court continue to adjudicate any motor vehicle case while operating a motor vehicle in violation of a state statute?

  1. There might be a good reason for her failure to get her car inspected. You never know. Maybe the DMV is prejudiced against lawyers? No? Maybe the DMV told her they might report her to the Ethics Committee? No, she's been there before. Maybe she told the judge she thought they might be against her for some reason and she was recusing herself from inspections. That sounds good.
Not wanting to appear as anything but PC, the judge would allow that.

  2. This is quite sad. And the Westfield Good Ol' Boys Club has become integrated! In Westfield we are to do as we are told, however that's only if we aren't "connected". Good for Marek Kaplo. I hope he proves his point and wins, but at what expense? Will the Westfield taxpayer get saddled with this settlement as well? And Ms. Gibbons can get her car inspected on Saturday! Court is closed and Rahway MVC is open. Can someone issue a summons here, please? What is the excuse for waiting ten months??? The purveyor of justice is, in fact, a scofflaw! Disgraceful! Great job TFOM! Keep up the good work!

    1. Why not issue the summons yourself. It’s quite simple really. Here’s how:

      A. Wake up every morning and run a few miles then sit through hours of boring lectures for about 6months and graduate the police academy.

      or

Walk into the municipal court and file the complaint.

Let’s see what you’re made of now.

    2. TFoTM was given the information for this blog story. The person that witnessed the infraction has filed the appropriate summons in court and it’s been transferred to Winfield.
Any civilian can file a summons, you don’t need to graduate from a police academy.

    3. That is only one summons, one should be issued every day the vehicle is in the parking lot. Every day is a separate violation.

    4. Why do police vehicles have window tint when the cops write people those tickets all the time?

      Are municipal vehicles exempt?

    5. The altering of driver and passenger side front windows is a violation as it falls under the altering of safety glass after market.
Many municipal police vehicles could possibly come with the tint already manufactured in the window.
Also, police are exempt from many other Title 39 motor vehicle laws in the performance of their duties.

    1. We live in the 1st world. Your comment doesn’t minimize the violation by an officer of the court.

  4. Why does it seem that the administration is not concerned with the Prosecutor who violated the law and the length of time involved?
Why doesn't the Public seem concerned with the qualifications of this lady to be a Prosecutor.
Why doesn't the Public seem to care about the alleged search for a Prosecutor conducted by the Administration when it said it would search for an experienced attorney?
Why doesn't the Mayor, or Town Administrator, walk down the hall while Court is in session, and ask a few of the lawyers, Dems and Reps. what they think of the ability of the Town Prosecutor and/or Judge.
Better yet, ask a few of the cops. They know when they are being represented by a good lawyer and when they have a slouch.
If you're worried about race, ask the police "of color". I'll bet they all wish they had the caliber of Prosecutor previously appointed.

  5. Is that scumbag Josh McMahon happy with himself now? After he had the police called on him while he was at the court window. Loser.

    1. I’m sure he is. Petty people find satisfaction in minutia. Instead of making the world a better place some people try to create chaos and insanity over nothing. Sound familiar?

  6. Yvette also parks in the 5 min taxpayer parking spots constantly during tax time. Taking away parking from taxpayers who pay hard earned money to live in town. She’s a joke and thinks she’s above the law.
