PART II: Corruption, Cronyism, Misconduct and Coverups: Westfield Town Administrator Jim Gildea Becomes an Accomplice

     In early July 2001, town administrator Tom Shannon, who was involved in the promotion of Bernard Tracy to police chief in October of 2000, suddenly resigned from his position leaving the town with assistant administrator Jim Gildea to oversee daily operations.
   
     The Westfield town administrator is responsible for making the police chief recommendation to the town council for approval.  At the time, Shannon would’ve been responsible for making the recommendation.

     Tom Shannon was notorious for instructing Westfield’s payroll clerk to issue $500 holiday  bonuses at the end of the year to a select number of town employees that he chose.  This illegal practice was met with refusal unless Shannon was willing to put the request in writing.  The bonuses never materialized.
     
     Assistant town administrator Jim Gildea didn’t have the certification to be the town administrator and was given a time frame to obtain the necessary certification.  The certification would allow him to become Westfield’s administrator for the foreseeable future.  Until he procured the required certification, he was named “acting” town administrator.

     Mayor Tom Jardim, after winning a second term in a landslide election in 1998, and the first Democrat to serve as Westfield mayor since 1912, did not seek re-election and a third two year term after he promoted Barney Tracy to police chief.  Replacing Jardim on the Democrat ticket was Westfield Board of Education member Susan Jacobson.  Jacobson was chosen to carry the torch for the Democrats but subsequently lost the November 2000 election to Republican Greg McDermott.
   
     By 2003-2004, Westfield Police Chief Barney Tracy had entrenched himself in town politics while the Westfield town council was debating the construction of parking decks.  The debate would ultimately lead to a referendum in which Westfield voters overwhelmingly defeated the parking deck proposal 77% against, to 23% in favor, with an 80% voter turnout in November 2004.
   
     It was during the town council discussions leading up to the referendum regarding the parking deck proposal, that a group of local residents from WECARE spoke out against the parking deck construction.
   
     Westfield Police Chief Barney Tracy began to target residents that approached the microphone during open public comment of the town council meetings to speak out against the construction of parking decks.
   
     Chief Tracy was complicit in having names of Westfield residents illegally run through the department‘s computer system to obtain information incriminating, detrimental, and embarrassing to those he targeted.
   
     Westfield resident James Abate, a practicing attorney, was arrested on a warrant for alleged failure to pay parking fines from another jurisdiction, as he walked away from the open public comment microphone after addressing the town council and opposing the parking decks.  Westfield parking director John Morgan was present during the arrest.

     Sitting Westfield Town Councilman Sal Caruana was allegedly a target of Chief Tracy’s illegal access of NJ State Police computer systems.  It is alleged that Tracy misspelled the councilman’s last name when conducting the check.
   
     Westfield resident Sarah Strohecker Clarkson, chair of the Westfield BRAKES group was targeted by Chief Tracy when she wrote a letter to the Westfield Leader critical of the police department.  He instructed a police department dispatcher to check her driver’s license, without probable cause, for any infractions, using the department’s computer system to illegally access NJ DMV records.
   
     Chief Tracy maintained a file on Westfield resident and parking deck opponent James Baker, a file  he held up to a member of the Westfield police department when referencing people who he thought were spewing anti-parking deck testimonials and should not be respected.
   
     McDermott’s tenure as Westfield’s mayor ended prematurely as he resigned on June 21, 2005 and the Republican’s selected sitting 3rd Ward Councilman Andy Skibitsky to take over as mayor.  This allowed Skibitsky to run as the incumbent in the November 2005 mayoral election.
   
     Mayor McDermott had relied on his parking director John Morgan, a Barney Tracy confidant, to provide parking statistics to the public and town officials, that supported the pro parking deck construction narrative.
   
     It was later revealed that some of the statistics had been fabricated leading some to believe that McDermott’s resignation was facilitated by the failed referendum and fabricated statistics, an embarrassment to his administration.
   
     The referendum was as much of a blow to Chief Tracy and Westfield Parking Director John Morgan as it was to Mayor McDermott.
   
     John Morgan would eventually leave Westfield after alleged complaints of sexual harassment and would be appointed Hoboken’s parking director until he overstayed his welcome in that city.
   
     The NJ State Police sent an investigator to Westfield to audit Westfield’s computer system after Chief Tracy coordinated the illegal computer checks on Westfield residents.  An NJSP audit allegedly  revealed that improper login ID’s were used to access the records.
   
     Westfield Town Administrator Jim Gildea was now front and center in the daily operations of town business as he had been named Westfield’s Town Administrator, stripping away the “acting” designation.
   
     What did Mayor Tom Jardim know?  He was Westfield’s mayor when the infamous “Tracy letter” was sent to town officials.  See contents of letter at the following link:

     Despite the warnings in that letter, the town council approved Tracy’s promotion to police chief.
   
     What did Mayor McDermott know?  He was mayor during the parking deck debate when Chief Tracy orchestrated the illegal criminal history checks on Westfield residents.
   
     What did Mayor Andy Skibitsky know?  He was a councilman when the parking debate was raging and the illegal criminal history checks were orchestrated by Chief Tracy.
   
     What did Westfield Town Administrator Jim Gildea know?  Gildea was assistant town administrator when the “Tracy letter” was sent warning town officials of Barney Tracy’s transgressions and later became the town administrator, witnessing Chief Tracy’s tenure of corruption.
   
     They all knew they had a rogue police chief in Barney Tracy.   Each of them allowed B. Tracy to either become, or continue as, Westfield’s Police Chief despite warnings of misconduct, corruption, and criminal activity.

     Chief Tracy’s regime embedded itself in town politics which allowed him to spawn a future police chief cast from his own mold while he targeted those that tried to expose the corruption and criminal activity of him and his underlings.  One of his first targets.....Officer Steve Elvin.

  4. As one of the targets of Tracy's illegal record checks, I can vouch for the above.
    Some of the targets were so fearful of the Town that they refused permission to the NJSP to discover who was misusing the system.
    It's good to ask why. It's good to find out who knew what. For an office holder, at that time, to deny knowledge would require the opinion that he was either lying or incompetent.
    Some may ask why it's important now. Some of the parties are still influencing the Town today. The present administration is NOT directly responsible for the past, but, they have to take responsibility now for the decisions they make or the facts they ignore.
    The present Town Attorney was the mayor who appointed Tracy. He and the present administrator either knew some or all of the facts or were oblivious and incompetent.
    The past occurred because it was probably easier to concede the appointment than to fight the scandals threatened. We have all seen what happens when the Town takes the EASY way out. Remember the allowance of Wayman to resign "in good standing" rather than fire him or allow him to be indicted. The present administration owns the mess it made. The Mayor and Town Attorney must have seen the videos of the misuse of evidence in the WPD. I would never accuse this administration of incompetence. I would infer a great desire to avoid scandal.
    I hope the administration realizes that they can't always evade and avoid. Sometimes they can really look good by facing the facts.
    I hope "The Fact of The Matter" continues to light the way.

    1. Barney Tracy knew that the State Police were coming to the WPD to investigate.

      His records bureau supervisor, John Parizeau, was in headquarters several late nights in a row to “get everything in order for the audit.

      When I was summoned by Chief Tracy to his office for my internal affairs interview regarding how I had obtained the information about his illegal use of police computers to do background checks on Westfield residents, he asked me how I knew about the State Police coming in to audit the WPD.

      It was supposed to be a secret that Tracy didn’t want let out.

      What was he hiding?

      Chief Tracy violated NJ Attorney General guidelines when he interviewed me because essentially he was interviewing a witness regarding his own crime.

      Fortunately, I had my attorney with me and the entire interview was recorded.....by Chief Tracy AND by me.

      Chief Tracy’s recording was mysteriously reduced to approximately 10 minutes and placed in my file while my recording, in its entirety, was 1 hour 12 minutes.

      That recording saved my pension when the town attempted to terminate me because I had blown the whistle on Tracy’s corruption.

  5. Just saw on NJ.com that this years Balloon Festival in Readington has been rescheduled from July to October due to the Coronavirus. Can someone please inform Barnie of the schedule change in case he plans on attending this event again.

All is so true and it is amazing that everyone in LILLY WHITE WESTFIELD who lives here and praises the town like it is GOD's LAND fails to admit that all of these people From McDermot & Mcd's DADDY, to SKIBITSKY, Gildea even ED Gotko (pre-Gildea) previous Town Administrator all have been on the take but HEAVEN FORBID we discuss these things or ADMIT them as residents because WE ALL MUST keep up the APPEARANCES that WESTFIELD is the wonderful world we all want everyone to believe in. The police force has TOTALLY become a NIGHTMARE after Chief Scutti, left. Lets not even discuss the FIRE dept. making PAUL (AKA JOHNNY DRINKS ALOT) Battiloro the chief only because he knew where all the BODIES were buried was absurd. Everyone was just waiting for that to blow up so they could ask him to resign (which it did quickly) and he did resign....But he did get his upgraded pension as CHIEF and his NEW CAR for a $1. The POLITICS in this town are a JOKE and unless someone Like GREG and this site STANDS up and makes people FINALLY except and no longer KEEP these things a secret NOTHING WILL CHANGE.

    1. The only Chief's to "retire" (NOT resign) with there Chief's car was (PD) Moran, (FD) Ridge and (PD) Scutti. The practice of taking the Chief car with you ended when Scutti retired.

  7. You come on here and insult a deceased man and basically praise another. I would reasonably assume your a retired Westfield employee. Did you work for Chief Battiloro? Did he deny you advancement through the ranks? If your as smart as you try to look you should know Chief Battiloro didn’t retire with his car however Chief Scutti did. Why don’t you stop playing keyboard badass and make your remarks to the family’s face. Let the “Chief“ Rest In Peace, because your comments only show the type of person you are.

  8. Article in nj.com "N.J. will name cops who commit serious violations, in major new directive by state Attorney General." NJSP Colonel Callahan has said he will be releasing Trooper names going back 20 years that were disciplined for serious offenses. This could get interesting for Westfield, wonder how far back they will go.

  9. Good morning. I was informed that this site might have someone with information of a criminal act committed by a Westfield Police Office back in the 1960's or early 1970's. I am with a group affiliated with Rutgers University who are researching past actions by Police that were either covered up or falsely reported and the victims are people of color.
    The incident Westfield was a motor vehicle infraction that led to the shooting of an unarmed black youth. The youth survived and no action was taken against the Officers. Our basic research reveals the Officer was Patrolman John Wheatley. It is our understanding that if this same incident occurred today the Officer would have been charged with attemtped murder or at least a felony assault charge, We have researched the Westfield Leader archives and have been unable to locate any mention of a shooting. It appears Wheatley continued on at the Westfield Police and retired as an assistant Chief.
    If someone has more information about this incident and most important a date of when it occurred, we can file the Open Public Records request to obtain further information. You do not have to indentify yourself at all. We just need a date or any other information you might be aware off. Thank you in advance.
