Drivers Charged with DWI

Both drivers involved in the fatal accident on North Ave. & Tuttle Pkwy have been charged with Driving While Intoxicated. Additional charges include reckless driving, failing to yield to a pedestrian, and failing to report an accident. Additional charges may follow as the Union County Prosecutors Office continues their investigation.

  1. Why has is taken an entire month for them to be charged? Highly unusual for DWI case. If they failed to report, how was their BAC obtained? Something doesn't make sense.

    1. It has been alleged that the BAC was obtained through blood tests. Results for blood tests take longer than results for a breath test. Breath test results are known within minutes of administering the test. Not so with blood tests where the results are much more reliable.

    2. The second driver was charged with Failure to Report the Accident. At the accident scene, Westfield Captain Dave Wayman had advised arriving County Ppolice officers that one suspect had fled the scene. He later advised the press that police knew who the suspect was, most likely because it was alleged that both drivers had just left the Knights of Columbus. If the second driver fled or left the scene, why was he not charged with Leaving The Scene of an Accident? One reason , because police told him he could leave and then once they realized he may have struck Mrs. Currie, they went and took him into custody for testing.

  2. The cops screwed up if they let the guy leave. Sets up a defense that he went home and drank after the accident.

  4. heard anything new on this case??? i work in insurance field and this whole case is a doozy!!!! Quite interesting actually as the woman who is now unfortunately deceased started the chain of events that followed......tough case to investigate all around....

    1. TFoTM does not understand why it is difficult to conclude this investigation. The blood alcohol level of both men charged with DWI is already known. The BAC level of the deceased, if any, would be in her autopsy report. If there were any substances in the blood stream of Mr. Kervick, that would be available in hospital records. The facts as to the actual occurrences of the accident are well known.
      Whatever delay in criminal charges being levied is unknown to TFoTM.
      The deceadent's son-in-law is a detective in the Union County Prosecutors Office. The prosecutor has already indicated that this was not a conflict of interest for him.
      Unless there have been facts elicited in the criminal investigation that might be considered sensitive to the parties or their families, TFoTM cannot understand the delay about which you make inquiry.
