Westfield Councilwoman JoAnn Neylan......Can You Explain?

Westfield Councilwoman JoAnn Neylan is the current public defender in Mountainside, NJ where a controversial case was transferred from Westfield municipal court.  The Mountainside prosecutor is former Westfield Councilman James Foerst.  Neylan was once employed by the lawfirm of Spector Foerst & Associates.

The controversial case involved Westfield Police Captain John Ricerca’s daughter who wasn’t issued any motor vehicle violations on the date of her accident, despite having multiple juveniles in her vehicle in violation of New Jersey Title 39 Motor Vehicle Law regarding probationary licenses.

The victim’s lawyer sought relief from the county prosecutor to extend the statute of limitations allowing for summonses to be issued on a later date when it was discovered the Westfield police initially neglected to ticket Ricerca.

While serving in the capacity of “acting mayor” in 2015, JoAnn Neylan administered the oath of office to Captain John Ricerca.

Mountainside prosecutor James Foerst sat on the Westfield Town Council when Ricerca’s promotion was approved.  The Ricerca Motor vehicle summonses eventually issued, were dismissed on grounds of “prosecutorial discretion” without the victim or victim’s attorney present in court.

Westfield town Councilwoman JoAnn Neylan, can you explain why the summonses were dismissed in Mountainside court citing “prosecutorial discretion” and how you, and Jim Foerst, don’t constitute a conflict of interest in this case being heard in Mountainside after being transferred from Westfield due to a conflict of interest?

    1. What needs to change is the process of how the next police chief is chosen.
      Town administrator Jim Gildea has recommended the last three appointments to the mayor (Skibitsky) and the town council has approved the recommendations.
      One might suggest that Gildea has ignored the warning signs regarding the ill-fated recommendations.
      Bernard Tracy: Allegedly walked out of a closed town council executive session when he was told that the town would hire an independent investigator to look into Sandy Chambers claim of sexual harassment. He allegedly told the members of the town council he quit after they refused to allow him to appoint Wayman as the lead investigator in Chambers claim.

      John Parizeau: Received a vote of “no confidence” from the members of the Westfield PBA towards the end of his tenure. Routinely took care of his own friends employed at the WPD.

      David Wayman: Way too much to list......history has a bad habit of repeating itself.

      Maybe the town administrator should be shut out of the selection process. He recommended Wayman as far back as when Wayman was a Lieutenant and Parizeau took the job.

    1. TFoTM will be seeking the “nolle prosequi” from the case to determine the reason for “prosecutorial discretion” allowing the tickets to be dismissed.

  5. Did Rattilloro crash a town vehicle into a parked vehicle while plowing the snow. Did he report it. Was an accident report filed. Is plowing snow in his job description. These questions are an indicator of how the upper rank do business. Any officer would be in deep shit if they did this. So lets promote him ASAP.

  6. No that was Battiloro, struck an employees vehicle, with a police vehicle, then didn’t file any reports and offered the officer cash to pay for damages! That is the facts.
