Karma

The Fact of The Matter has exposed corruption involving disgraced ex-police chief David Wayman who was forced out in 2018. 

Westfield police officers that worked during Wayman’s tenure as a police officer can attest to the statement pictured below the photo of Wayman.

    1. They ended up stripped from the Tahoe when Battiloro was promoted to police chief. They were sitting in the DPW garage where they were stripped and a DPW employee took them and put them on his own Tahoe.

  6. On January 30, 2021 Anonymous posted on a previous post that a WPD Lt. and Sgt. wrongfully suspended an Officer for doing his job.
    Did the Officer do something "egregious" to warrant such a suspension or was it the actions/orders of the Lt. & Sgt. who suspended the Officer "egregious" in nature ?

  8. The officer stopped a vehicle, but did not issue a ticket, to the driver. The supervisor then ordered the officer to write an officers report as to why he didn’t ticket the driver. The officer then asked pba rep what to do and was advised not to hand in officer report until it was reviewed with pba rep. Supervisors than suspended the officer for insubordination. The supervisors came to the conclusion that the officer didn’t issue ticket because he’s racist. These are the facts of the matter.

      Why not just write an officer’s report that states the officer has the discretion to write a ticket or not write a ticket?
      There seems to be more to this story.
      The supervisors came to the conclusion that the officer didn’t right the ticket because he’s (the officer) racist?

    2. Like you said, there HAS to be more to this story. I heard the Officer involved had just been transferred to that platoon due to the yearly shift pick changes. During one of his first shift lineups on his new shift the Supervisor allegedly ordered him NOT to pull over vehicles unless it was a serious "egregious" violation because the Supervisors knew he was looking to work (stop cars and make arrests). So the Officer went on patrol and did his job and the lazy Supervisor(s) didn't want to get involved with any related paperwork they may have to do if the Officer gets an arrest. Then the Lt and/or Sgt. suspend him on the spot.
      I thought when an Officer gets suspended by a Lt. and/or Sgt., the Officer along with the Supervisor that suspended the Officer is to report to the Chief's Office the very next morning. Did that occur ?, was the Attorney General guidelines regarding the Officer's suspension followed ? Who was notified and when ? Is it true that the Officer involved was immediately put back on his old platoon and away from the Lt. and Sgt.?

      What this comes down to is the Lt. and Sgt. did NOT want to get involved with doing their job, additional paperwork, if the officer were to make an arrest. Which I find odd since the Lt's spouse used to stop cars every 3-4 minutes on the midnight shift looking to, "sniff out", arrest drunk drivers which created more paperwork for his Supervisor, but HE was allowed to go out and work.

      I'm sure there is an internal affairs investigation in place and that the Officer who was suspended will come out on TOP when the dust settles and this incident will possibly cost the Town when all is said and done.

      Sounds like there are several separate issues.
      1. Officer suspended for insubordination for not following an order to complete an officers report.
      2. Officer instructed not to make car stops unless it’s for an egregious offense.
      3. Were proper steps followed in the suspension of the officer and was the suspension justified.

      I will assume that the spouse you are referring to is the spouse of former officer James Stivale.

      In 2006 I was assigned to district 4 one evening and Officer Jim Stivale was assigned to district 1.

      Late in the evening as I traveled east on South Avenue near the intersection of West Broad Street I watched district car 41, with its overhead lights activated, make a left turn onto West Broad Street after it had travelled through the South Ave. circle.

      Immediately, I knew something was up. I never heard Stivale notify dispatch that he was leaving D1 to follow a vehicle.

      When the light turned green, I rounded the corner and saw that Officer Stivale had stopped a vehicle, but did not call out the car stop.
      I backed up Officer Stivale, and I called out the car stop.
      Dispatch asked what was the reason for the stop and I stated I did not know, it was Stivale’s car stop.
      Stivale looked up, saw me, gave the credentials back to the driver. I asked him “What’s up?”
      His response, “Nothing, going 10-8.”
      Dispatch again asked 41 the reason for the car stop at which time Stivale stated, “Disabled motor vehicle, it’s on its way.”

      I smiled, shook my head, and knew the car stop was fabricated......and here is how I found out.

      First of all, how does a D1 patrol vehicle just happen to stumble upon a disabled MV in D4?

      After the car stop, as the vehicle pulled away, I followed it down W. Broad St. For whatever reason, the vehicle pulled over near N. Scotch Plains Ave.
      I pulled up alongside the vehicle and asked the driver if everything was ok and the driver said “Yes, no problem officer.”

      I then asked the driver why he was pulled over back at W. Broad St. to which he responded, “The officer said I was speeding.”

      Now I knew Stivale had not only lied to dispatch, but he fabricated probable cause to stop the vehicle.

      This wasn’t uncommon with Stivale. After all, he joined the department 6 months after me and I knew his “M.O.” over time.

      He would make a shitload if car stops every night and only call out a few, the few that resulted in a drug arrest, DWI arrest, or warrant arrest. This strategy would increase his stop/arrest percentage and make him look like some super cop.
      He was now caught.

      I wrote the license plate down of the car he stopped that night and filed it away in my notes/diary as I had been doing religiously after Chief Barney Tracy and later, Captain Wayman, sought to fire me for outing their corruption.

      PAYBACKS ARE A BITCH
      A few years later after my retirement I was playing softball with a teammate who had informed me he was stopped in Westfield the previous week and was arrested for DWI.

      When I asked him who the officer was he told me “officers Stivale and Officer Scourzo.
      He confirmed it was Jim Stivale.

      My friend was stopped, facing west on North Avenue in front of the Coldwell Banker building. He was stopped at a red light when a police car rolled up to the intersection and came to a stop.

      On the opposite side of the intersection heading east was a Westfield patrol vehicle with Jim Stivale in it.

      I asked my friend what reason the officers gave him for the car stop and he stated “speeding.” I immediately recognized the fact that the speed limit is 35 miles an hour and my friend had been stopped at a stoplight. How is it possible that he could’ve been speeding in between the light turning green and him entering the intersection and passing Stivale?

      I recalled the fabricated probable cause that Stivale had used in 2006, “speeding.” He used it a number of times on stops I had backed him up on including stopping the same black driver twice in one week that drove to his late night shift an Stop & Shop on Elm St.
      Funny thing is that Stivale never had the speed of the vehicle locked into his radar. Hmmm

      Eventually, my friends DWI case made it to court and was thrown out because Stivale never showed up to testify claiming an injury and unable to work.
      More like scared to get cross examined and caught in a lie.

      He hung Scourzo out to dry, forcing him to testify in court.

      The defense attorney, John Blake, requested Stivale’s personnel file to be exposed in court.
      Prosecutor Christine Nugent fought ferociously to prevent it.

      Ultimately, the case was dropped because Stivale’s past record of fabricated probable cause was brought to light.

      Lt. Nicole Stivale spent the least amount of time in patrol of any supervisor ever promoted to the rank of Lieutenant. Her allegiance to Barney Tracy after Tracy hired her as a political favor to her family, and her role as Wayman’s rat eventually paid off even though she turned the tables on Wayman during Wayman’s ouster.

      All the Linden hires at the time can be traced back to Tracy’s employment with the Linden BOE upon his shameful retirement from the WPD.

      Jim Stivale never returned to work after that DWI trial and took an early retirement of 20 years. How could he, his scam was outed. Every one of his previous car stops could be called into question and every one of his future car stops could be challenged.

      Similar to Leo Lugo and his continued employment after being caught in an alleged lie by fabricating a hit and run report for Wayman and as an alleged accomplice to Wayman’s thievery.

  9. The Lt. in question spent a whopping total of less than a year and a half, ON THE ROAD, as a Patrol Officer and that included her training period.

    After returning to work after her second maternity leave, she was immediately put into an administrative role as then Capt. Wayman's unofficial secretary doing his administrative paperwork and P.O.S.S. entries (which is usually the Patrol Captain's job) before being put into the evidence room due to PD shortages. Rumor had it that Wayman had asked for a secretary and was denied.

    When she was acting as Wayman's unofficial secretary, Wayman had the opportunity to show up later in the day due to his late night festivities, etc.

    The PBA contract has a required minimum amount of time an Officer has to be on the job to take the promotional exam for Sergeant, I believe its 5 years to ensure said Officer has the needed experience, although the Lt. did have the time on the job, she lacked the time on the road doing the job of a Patrol Officer.
    Perhaps the PBA should change the language to read to 5 years experience in Patrol as a Patrol Officer.

  10. I'm not "on the job" but living in Westfield and being aware of my surroundings it always seemed like WPD profiled their MV stops. Ask any high school kid with a license to drive if he/she has been questionably stopped? I'm sure Officer Stivale was the tip of the iceberg. It has always been evident that the WPD is a cash register for the town coffers. They prey upon a weak, ignorant, uninformed, poor public. It's truly a shame. Imagine if there was real crime in Westfield?
